The US Citizenship and Immigration Services (USCIS) has announced a significant update that will be beneficial for Indians, especially those awaiting their US green cards. In this recent development, the US will grant employment authorization cards, known as EADs, with a five-year validity to certain non-immigrant categories, including individuals waiting for green cards.
US immigration services have extended the maximum validity period for Employment Authorization Documents (EADs) to five years, both for initial and renewal EADs. These changes apply to specific non-citizens who need to apply for employment authorization. These categories include asylum or withholding of removal applicants, those seeking adjustment of status under INA 245, and individuals facing suspension of deportation or cancellation of removal, as stated by the federal agency.
This extension of the EAD validity to five years is aimed at reducing the number of new Forms I-765 and aiding in the USCIS’s efforts to decrease processing times and backlogs. It’s important to note that whether a noncitizen maintains employment authorization depends on their underlying status, circumstances, and the specific EAD filing category.
For example, if someone receives an EAD based on a pending adjustment of status application with a maximum validity period of five years, and their adjustment application is later denied, their supplementary employment authorization may be terminated before the expiration date indicated on their EAD.
It’s worth mentioning that over 1.05 million Indians are in the queue for an employment-based Green Card, and unfortunately, around 400,000 of them may pass away before receiving this highly sought-after legal document for permanent residency in the US.

What is a green card?
A Green Card, also known as a Permanent Resident Card, is a document granted to immigrants in the United States, demonstrating their right to live permanently in the country. The per-country caps indicate specific numerical restrictions on the issuance of green cards to individuals from particular nations.
A recent study by David J. Bier at the Cato Institute, a libertarian think tank in the United States, has disclosed that the backlog for employment-based Green Cards has reached a record high of 1.8 million cases this year.
Out of these 1.8 million cases, roughly 1.1 million (63%) are from India, and nearly 250,000 (14%) are from China, as per the think tank’s report.
